Terms of Agreement.
This is an EQUIPMENT RENTAL AGREEMENT entered into by and between YOU (“Customer”) and Kingllusion Computers Ltd. (“Kingllusion Rentals”) entered into the day and date hereinafter set forth.
1. Term of Agreement. The parties do herein bind themselves to the terms of this Agreement in regard to all equipment rented by Customer from Kingllusion Computers from the date of this Agreement until terminated, modified or replaced.
2. Non-Exclusivity. This is a nonexclusive Agreement, nothing herein contained shall obligate Customer to rent from Kingllusion Computers nor Kingllusion Computers Ltd to rent to customer during the life of this Agreement. However, in the event of rental transactions this Agreement shall govern until it has been modified, terminated or replaced.
3. Price. Unless otherwise agreed to in writing by an authorized agent of Kingllusion Computers Ltd, the price listed in the Kingllusion Computers Ltd. Equipment Rental Catalog in effect at the time Customer receives rental equipment shall control.
4. Warranty of Authority. Customer hereby warrants that any person which it directs or allows to receive equipment from Kingllusion Computers Ltd and who shall sign for acceptance of said equipment is authorized by Customer to do so. Customer herein waives any obligation on the part of Kingllusion Computers Ltd to confirm said person’s authority to act on behalf of Customer.
5. Maintenance of Equipment. The Customer agrees to keep and maintain all of the rental equipment in good condition and assumes full responsibility for all the equipment and supplies until the rented items are returned. The Customer agrees not to remove, cover, alter or deface any tags, serial numbers or nameplates on the equipment.
6. Insurance. The Customer agrees to obtain, at Customer’s own expense, all-risk insurance coverage equal to the replacement value without deduction for depreciation of the rented equipment. The equipment must be insured by the Customer before it can leave the premises of Kingllusion Computers Ltd. and must include in-transit/shipment insurance coverage. The Customer agrees to provide written certification and proof from Customer’s insurance company of an all-risk policy naming Kingllusion Computers Ltd. as a loss payee for any and all claims including coverage of the equipment while in possession of a common carrier during shipment.
7. Lost and/or Damaged Equipment. In the event of any loss or damage to the rented equipment, the Customer agrees to pay the rental rate during the period of time Kingllusion Computers Ltd. is deprived of the equipment and until such time as it is repaired and/or replaced. The Customer agrees that the value of the rented equipment, in the event of damage and/or loss requiring replacement rather than repair of said equipment is the replacement value as determined by the manufacturer’s list price at the time of said loss.
8. Inspection of Equipment. The Customer acknowledges that Customer’s agent (as defined in paragraph 4 above) by executing a Rental Form for particular equipment warrants on behalf of Customer that the equipment has been examined and tested by Customer and that the same is in good working order and condition. In the event equipment is shipped to Customer, Customer failure to notify Kingllusion Computers of any defects or problems with equipment within 24 hours of receipt shall be conclusively deemed as acknowledgment that all equipment has passed customer approval and is in good working order.
9. Exclusion of Warranties. CUSTOMER HEREIN ACKNOWLEDGES THAT ALL EQUIPMENT TO BE RENTED FROM KINGLLUSION COMPUTERS WILL BE AS A RESULT OF CUSTOMER’S SOLE SELECTION, DISCRETION AND OPINION AS TO EQUIPMENT WHICH IT REQUIRES. ALL EQUIPMENT IS ACCEPTED BY CUSTOMER “AS IS”. NO WARRANTIES OR REPRESENTATIONS ARE MADE BY KINGLLUSION COMPUTERS OF ANY TYPE OR NATURE WHATSOEVER, EXPRESSED OR IMPLIED, REGARDING THE PERFORMANCE OF LAPTOPS, SERVICES, SUPPLIES, OR OTHER EQUIPMENT RENTED. KINGLLUSION COMPUTERS HEREIN EXPRESSLY EXCLUDES ANY AND ALL WARRANTIES, GUARANTEES, EXPRESSED OR IMPLIED, STATUTORY, BY OPERATION OF LAW, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT, UNDER NO CIRCUMSTANCES, SHALL KINGLLUSION COMPUTERS BE RESPONSIBLE OR LIABLE TO CUSTOMER OR ANYONE ELSE FOR ANY DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS OR OTHER DIRECT OR INDIRECT INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE ANY EQUIPMENT RENTED OR THE ALLEGED BREACH OF ANY AGREEMENT DESCRIBED HEREIN, EVEN IN THE EVENT THAT KINGLLUSION COMPUTERS LTD OR KINGLLUSION COMPUTERS’S AGENTS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Indemnification and Hold Harmless. The customer agrees to assume full responsibility and liability for the safekeeping and return of all rented equipment accepted by Customer as shall be set forth in Kingllusion Computers’s Rental form. Customer agrees to indemnify and hold harmless Kingllusion Computers and any other persons to which Kingllusion Computers itself may be responsible to indemnify and hold harmless, from any and all liability, claims, damages, costs and expenses arising from Customer’s use, misuse and/or possession of the rented equipment.
11. Returned Equipment. Acceptance by Kingllusion Computers Ltd. of the return of rented equipment does not waive any claims that the company may have against the Customer for patent, latent or hidden damage to the equipment. Kingllusion Computers Ltd shall have a reasonable period of time after return of said equipment to discover said damages.
12. Inspection/Repossession of Equipment. The Customer agrees to admit any employee or agent of Kingllusion Computers Ltd. to enter the premises upon which equipment is kept for the purposes of checking the condition of the company’s equipment and/or for repossessing the equipment in the event the Customer is in default of any term of this Agreement whatsoever.
13. Exclusive Possession/Non-Assignability of Lease. The Customer shall not sublease or loan the equipment or assign this Agreement to any other persons, firms or corporation and said equipment shall at all times remain under the immediate, exclusive control and direction of the Customer.
14. Cost of Shipment. When required, Kingllusion Computers shall arrange for shipment of rental equipment to Customer and any and all shipment costs incurred by Kingllusion Computers shall be a charge included against Customer’s account.
15. Miscellaneous Provision for repairs, etc. The Customer specifically acknowledges Kingllusion Computers Ltd.’s ownership of the equipment and agrees to keep the equipment free of all liens and encumbrances. The Customer agrees that he shall be liable for all taxes, transportation charges, duties, broker fees and any and all other costs imposed upon the equipment.
16. Governing Law. This Agreement and all the rights and liabilities of the parties hereto shall be governed by and construed in accordance with the laws of the State of Lagos.
17. Headings. The headings as to the contents of particular paragraphs of this Agreement are inserted for convenience and reference only and shall not be construed as a part of this Agreement nor be considered in construing the terms hereof.
18. Entire Agreement. This Agreement sets forth the entire understanding and agreement between the parties hereto with respect to the subject matter hereof, and cancels and supersedes any prior oral or written agreement between the parties with respect to the subject matter. No alterations, additions, amendments or modifications to this Agreement shall be binding unless made in writing and executed by an authorized agent of Kingllusion Computers Ltd.
19. Construction. In the event any parts of this Agreement are found to be void, the remaining provisions of this Agreement shall be binding with the same effect as if the void parts were not included.
CUSTOMER DOES HEREIN WARRANT THAT ITS AUTHORIZED AGENT HAS READ THE TERMS OF THIS AGREEMENT, UNDERSTANDS THE SAME AND DOES SIGN IT ON BEHALF OF CUSTOMER AS CUSTOMER’S FREE ACT AND DEED. THE BELOW SIGNOR FOR CUSTOMER DOES HEREIN WARRANT THAT HE/SHE IS DULY AUTHORIZED TO BIND CUSTOMER TO EACH AND EVERY TERM OF THIS AGREEMENT.

General Conditions for the hiring of equipment
Basic Rent Charges
Multiple options are provided to charge the rental and recurring payments.
Delivery and Return Charges
Hire charges usually include delivery charges until specified at the time of delivery of the rented equipment. You may need to pay to us any agreed charges for delivery or collecting Equipment.
Safety and Instructions
All the equipment are delivery after through checking, but it is the responsibility of hirer to maintain it in such a manner to ensure its safety and make sure that all people who use the equipment(s) are properly instructed in its safe and correct use and that they are in possession of all instructions supplied by the team of Kingllusion Computers. You must ensure that the equipment is not misused.
Responsibility of hirer
Responsibility of the equipment begins when you or your employee/agent receive the equipment.
Responsibilities include safekeeping of the equipment, and protection against the elements, theft, vandalism or improper use.
Hirer is responsible to return of the equipment or making clear arrangements with support of team of Kingllusion Computers for the collection of the equipment at the end of rental duration.
Responsibility ends only when the equipment has been returned or collected, and you have no pending possession of the equipment which are supposed to be returned. You must not sell or otherwise part with control of the Equipment.
Maintenance of equipment and breakdown reporting
Any breakdown or any unsatisfactory working of equipment must be immediately notified to the support team of Kingllusion Computers. All the rented equipment must be returned back at the end of rental duration. Under no circumstances, hirer repair or attempt to repair the equipment unless authorized by the support team of Kingllusion Computers in written. Hirer must also notify immediately if the Equipment is involved in any accident resulting in damage to the equipment or accessories, or injury to any person due to the faulty equipments. Kingllusion Computers support team ensures that repair or replace of faulty equipment or components provided as under this agreement. Printer consumables are the responsibility of the hirer, and Kingllusion Computers do not guarantee that a rental printer will have a full supply of consumable at the commencement of the contract.
Location of equipment
Equipment must not be removed without our authority from any site originally specified by the hirer or from any site where it is originally delivered.
Limit of liabilities
Kingllusion Computers will not be liable for any damage, losses, costs or delays caused by any circumstances beyond its reasonable control. We will not be responsible for or liable for any problems caused by hirer or user data, hardware or installed software. Kingllusion Computers will not be held liable for any issues caused by your internet service provider. Kingllusion Computers will not be liable for any indirect loss, loss of business, profits, savings expected to make, wasted money, wages, fees or expenses, etc., due to a delayed service call, late or non-delivery, unsuitability of equipment, incorrect advice, breakdown or stoppage of any equipment or any part of it. India Rentalz will not be liable for supporting equipment which is over certain age, availability of parts and significant likelihood of failure.
Technical support
You can call support helpline 9:00 and 17:30 with technical queries. If we cannot fix your problem over the telephone then a visit by one of our engineering staff will be arranged or otherwise the rented equipment will be called off.
Quotation
Any quotation given by us does not constitute an offer to contract, and no contract will result until you have placed an order that has been approved after the approval of KYC.
Termination of rental duration
Kingllusion Computers will be entitled, at any time, if hirer breaks any contract conditions, or if any proceedings are commenced in which hirer solvency is called into question to terminate this contract with immediate effect and to repossess any or all of the equipment.
Kingllusion Computers right of access
Hirer authorize a team member of Kingllusion Computers to enter any land or premises where they reasonably believe any equipment to be, in order to inspect, test, repair or repossess it.
Rights Reserved
Any failure by Kingllusion Computers to enforce any or all of these conditions shall not amount to, or be interpreted as, a waiver of any rights.
Separate terms validity
If any term in this contract is held invalid, this shall not affect the validity of the remaining terms. The headings in these conditions are for reference purposes only and shall not affect the interpretation of these conditions.
Payment and Refund Policy
The minimum usage tenure, deposits, and refund policy are as follows:
There is a minimum usage tenure as selected by the hirer at the time of placing the order. Hirer can continue to rent the product for the same monthly payment. In the event the hirer wishes to return the product, a request needs to be send to Kingllusion Computers. As the rental charges are predecided on the factor including duration for which the equipment is hired on rent, an early closure charges might be applicable and will be settled from the security amount.
Rental duration is automatically renewed if there is no action from the hirer's end after crossing their minimum rental tenure. However, if the hirer is sure to keep the rented equipment for a longer period, they are requested to extend the minimum usage tenure in order to avail the same monthly rent.
Kingllusion Computers team will support the hirer in picking the product back up after the completion of the rental tenure and upon successful quality check the refund process will be initiated to the registered bank account or source of payment within 3 working days. No interest is paid on the security deposit amount taken at the time of placing the online order.
In the unlikely situation if the equipment gets damaged arriving at your doorstep, it is the responsibility of the hirer to report it to the support team of Kingllusion Computers about the same.
Kingllusion Computers ensure that all equipment is new or nearly new when it arrives at its hub facility, with no compromise on quality. There are a series of stringent quality checks that are undertaken on every piece of equipment before its delivery. However, if the hirer don’t like the equipment at the time of delivery, contact Kingllusion Computers support team.
There are no cancellation charges as such before the goods are delivered. However, in the event that you have placed an order for multiple items and the delivery agent has reached your doorstep, and you wish to cancel all your chosen items, then you may be liable to pay the expenses incurred on the delivery.
Delivery Options
Kingllusion Computers offer free local delivery and pickup ion the Lagos lsland, Lekki, Ajah, Sangotedo, Awoyaya and Lakowe along with services.
Usually, delivery charges are included in the security and monthly rentals. Still in case for any special requirement or far off places, delivery charges may be applicable and will be intimated to you at the time of delivery.
All the equipments are shipped to arrive within 3 days for all the abovementioned locations. Shipping to other locations take up to 7 days.
Delivery contact person will be shared once the equipment is shipped from the dispatch location. The hirer will be contacted for any delivery delays.
Though are no maximum number of delivery attempts. The hirer is contacted repeatedly and attempts are made till delivery is completed. It is in the best interests of the hirer to avail of delivery in the first two attempts.
Typically, all the products are delivered with complete check audit and proof of delivery. In case hirer receive any damage or faulty product, they should immediately coordinate with the support team or call us at 08147047838 within 24 hours of successful item delivered.
It is the responsibility of the hirer to accept delivery of the equipment after checking the condition of packaging and to have valid proof for claiming any damaged product delivered. Rest assured, the support team will help you with replacement of the damaged product.
Express delivery are available on request and shipping charges will be paid by the hirer
After the successful order placed and delivery is completed, the hirer is abide to the terms and conditions as mentioned on this website. In certain cases, the hirer of equipment would also have to sign the agreement document (detailing the subscription terms, conditions other relevant information) along with the checklist of items received.
Return Options
The rental duration automatically get extended without any specific intimation to the hirer, in case the rented equipment is not returned by the hirer.
The support team will coordinate with the hirer for the pickup of equipment to be returned.
The hirer should take the responsibility to ensure that all the items to be returned should be packed, preferably in original packaging and have a proof of all the equipment items are packaged without any damage.
All the security refund of the rented equipment will be returned to the hirer within 3 days after the receipt of returned equipment and checking the working conditions of the equipment items by the Kingllusion Computers team
